The purpose of the research is to highlight problematic issues that are connected to criminal and legal protection of human health and offer corresponding changes to current criminal legislation of Ukraine. To achieve this, there were the following tasks set: to analyze the Project of the Criminal Code of Ukraine in the part of (causing harm to human fetus; causing harm during sports activity; serious damage to health; suffering; abuse; domestic violence); to perform comparative analysis of some clauses of the Project of Criminal Code of Ukraine and current criminal legislation. Methodology. The issues of human health protection are the object of continuous scientific researches that have been going on since the moment of the appearance of first countries. Therefore, they require correct methodology. The choice of research methodology has to ensure systematic study of modern trends in rulemaking in the sphere of criminal and legal protection of human health. According to the stated objective, specific character of the object and subject of the research, there were chosen specific methodological tools. The study, analysis and generalization of results have been carried out. Thus, during the analysis of current criminal legislation and the Project of the Criminal Code of Ukraine the comparative legal method was applied. The special method of research that was used in the article was the method of system analysis. Scientific novelty of the research is that, based on the analysis of current criminal legislation and the Project of the Criminal Code of Ukraine, the possibility and advisability of the improvement of the criminal legislation in the sphere of human health protection was justified. Conclusion. The terminology of the Law of Ukraine on criminal liability should be exact, correspond to the contents and avoid unnecessary detail. The change of certain clauses of the Criminal Code of Ukraine would provide exact and total compliance of the meaning of certain terminology with its intended purpose; comprehensive legal regulation, clarity and accessibility
